Terms of Service

By accessing or using RestaurantOS at restaurantos.kinxso.com (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including restaurant owners, managers, staff, and any person accessing the Service on behalf of an organization.

RestaurantOS is a cloud-based restaurant management platform provided by Kinxso Technologies that includes point-of-sale (POS), kitchen display systems (KDS), inventory management, customer management, accounting, and related modules (collectively, “the Service”).

You must register for an account to use most features of the Service. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use at legal@kinxso.com

You may not share your account credentials with others or create accounts for the purpose of abuse.

RestaurantOS is offered under subscription plans (Starter, Professional, Enterprise). By subscribing to a paid plan, you authorize Kinxso Technologies to charge your designated payment method on a recurring basis (monthly or annually, as selected). All prices are shown in Pakistani Rupees (PKR) unless otherwise stated.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time from the Subscription settings page. No refunds are issued for partial billing periods except where required by applicable law.

Payment processing is handled by Stripe, Inc. and is subject to Stripe's terms of service. Kinxso Technologiesdoes not store full payment card details.

New accounts are granted a 14-day free trial of the Starter plan. No payment information is required to start a free trial. After the trial period ends, continued use of the Service requires an active subscription.Kinxso Technologies reserves the right to modify or discontinue the free trial at any time.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Upload or transmit malicious code, viruses, or disruptive content
• Reverse engineer, decompile, or extract source code from the Service
• Resell or commercially distribute the Service without authorization
• Use the Service to process data in violation of any data protection law

You retain ownership of all data you input into the Service (“Customer Data”). Kinxso Technologies processes Customer Data solely to provide the Service and as described in our Privacy Policy.

You grant Kinxso Technologies a limited, worldwide, non-exclusive license to use Customer Data to deliver, improve, and support the Service. Kinxso Technologies will not sell Customer Data to third parties.

The Service, including all software, design, trademarks, and content created by Kinxso Technologies, is the exclusive property of Kinxso Technologies and its licensors. These Terms do not grant you any intellectual property rights in the Service beyond the limited right to use it as described herein.

Kinxso Technologies targets 99.9% monthly uptime for the Service. Scheduled maintenance windows will be communicated in advance where possible. Kinxso Technologies is not liable for outages caused by third-party hosting providers, internet service providers, or force majeure events.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINXSO TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR REVENUE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO KINXSO TECHNOLOGIES IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You may terminate your account at any time by contacting us at legal@kinxso.com. Kinxso Technologies may suspend or terminate your access to the Service for breach of these Terms, non-payment, or misuse, with or without prior notice depending on the severity of the breach.

Upon termination, your right to use the Service ceases immediately. Customer Data may be retained for up to 30 days post-termination and then permanently deleted, unless we are legally required to retain it longer.

Kinxso Technologies may update these Terms from time to time. We will notify registered users by email or in-app notification at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes arising from these Terms shall be resolved in the courts of Pakistan, and you consent to the exclusive jurisdiction of such courts.
